Workers’ Rights

Workers have rights that are protected under a number of laws.  Your safety and health on the job is a fundamental right protected by both state and federal laws.

You have the right to:

  • A place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees.
  • Know what chemicals and substances you are exposed to at work.
  • File a complaint with the Department of Labor if you believe that a violation of a safety or health standard exists, or that an imminent danger exists.
  • Exercise your safety and health rights without retaliation or discrimination.

If you feel that your employer is violating any safety and health regulation contact your local president.  CSEA has staff (link to the Help! page) to assist with filing complaints with the appropriate regulatory agency.  If you are in a situation at work in which you feel your life is in immediate danger or you are at risk for serious physical harm you can at anytime contact the NYS Department of Labor.  Follow this link to find the nearest DOL office.  Typically complaints must be in writing and signed by the employee OR their representative (Download the PESH Notice of Alleged Violation).
