The Safety Net – Workplace Violence Prevention

Workplace Violence Prevention Programs Annual Reviews

Title 12 of the New York State Code of Rules and Regulations, Part 800.6 (12 NYCRR 800.6), is the NYS Public Employees Workplace Violence Prevention Act, which was passed into law on June 7, 2006, and expanded to include school districts on Jan. 4, 2024.

Unlike other laws, this one includes annual requirements for public employers to review workplace violence incident reports from the previous year to identify trends and develop control measures to prevent similar incidents. It also requires employers to provide annual, site-specific workplace violence prevention training that identifies risks and outlines the control measures in place to protect employees.

Another ongoing, but not annual, requirement is for employers to conduct workplace reviews when existing facilities are updated or new facilities are built to ensure workplace violence controls are in place, such as swipe card access for employees and secure visitor areas.

The law requires employers to evaluate the effectiveness of their workplace violence control measures by performing, at a minimum, an annual review of incidents from the previous calendar year.  This review typically occurs in March or April of the following year to allow time for reports to be finalized and collected.

This review must be conducted with the participation of authorized employee representatives, or AERs, typically the CSEA local president or another designated local officer. It must include a review of actual incident report forms, not a summaries or portions.  Some employers with larger numbers of incidents may conduct reviews more frequently, either biannual or quarterly.

It is critical that CSEA participate in the reviews to ensure effective control measures are implemented and that the responsibility for preventing workplace violence remains with the employer, not the membership.
