Workers’ Compensation/Social Security Disability

NYS Workers’ Compensation (WC) is a mandatory benefit, paid for by your employer. Workers’ Compensation benefits entitle you to full coverage of related medical care and hospital treatment for job-related illnesses and injuries for a minimum of 18 years, partial wage replacement for temporary or permanent loss of earnings, or a variety of death and survivor benefits.


Social Security Disability Insurance (SSDB) provides monthly benefits to workers who meet the Social Security Administration’s definition of “disabled”. If you are under age 67 and have been out of work for at least 5 months due to illness or injury (does not have to be work-related), and your doctor expects you to be out of work for at least a year, you may be eligible for SSDB. This is true even if you are receiving Workers’ Compensation and/or retirement benefits.
